Measure 5 Defeated | Video

The only constitutional measure not to pass on election day was Measure 5. It would have made it a felony to maliciously or intentionally harm a cat, dog or horse. Of the people who voted, 65 percent said no, and only 34 percent yes.

"Our victory was that we were able to bring the issue to the forefront. We were able to tell North Dakotans that we thought we had a weak animal cruelty law," said Measure 5 proponent Jane Marum.

"North Dakota animal stewards are very pleased that North Dakotas voters stood up for all animals and rejected a measure that was poorly worded and narrowly focused," said Measure 5 opponent Jessie Bateman.

The opponents plan on presenting a different animal cruelty draft bill to the legislature in January.
